What is my case worth?
This question sounds simple. Answering it accurately is a lot harder. Some things often considered are:
1. Type and severity of your injuries. Did you sustain a catastrophic injury like a spinal cord injury or serious brain injury, broken bones, joint injuries or do you have a back strain that was treated with medicine and physical therapy?
2. Medical Expenses. Your medical bills to date and estimated future medical expenses like hospital bills, doctor’s visits, medication, MRIs, surgery and other care.
3. Fault. Was the truck driver 100% at fault or were you in part responsible for causing the crash?
4. Pain and Suffering. Past and future pain, suffering, disfigurement and other damages.
5. Permanence. Did you recover completely, have ongoing pain, other problems or permanent disability after treatment is finished?
6. Past and future lost wages. Lost income due to being off work because of your crash. If you can’t return to work or do the job you had when injured and have to take a lower paid job this can include the value of your lost future earnings.

Why are Truck Accident Cases Different?
Truck crash cases are usually much more complicated than most car accident cases. Some reasons are:
1. Different Rules. All drivers must obey traffic laws. Most trucking companies and truckers must also follow the Federal Motor Carrier Safety Regulations (FMCSRs). The FMCSRs are hundreds of pages of rules on trucker training, licensing, qualifications, hiring, truck safety and more. To do the best job in your trucking case, your lawyer needs know the FMCSRs well enough to use them in your case. 2. Different Evidence. Truck crash evidence is more extensive and technical than in most car accidents. Inspecting the semi, downloading it’s “black box”, reviewing dashcam video, driver logs and other FMCSR required documents are all common steps in working up a truck accident case. Understanding and effectively using this requires specialized knowledge and experience beyond that needed in most car accident Investigations.
3. Different Insurance. Most trucking company insurance policies have more coverage and different terms than car insurance policies. In some cases there may also be insurance beyond the trucking company’s basic policy that can be tapped to recover more money if your lawyer knows where to look.
4. Federal Court. Most car accident cases are filed in state courts. Many truck crash cases are filed in federal court. Others are filed in state courts and the trucking company “removes” it to federal court. Generally, handling cases in federal court is more technical and demanding with more deadlines and potential pitfalls. How long will my case take?
Unfortunately, there is no exact way to predict this. Some cases settle quickly. Due to their complexity, many truck accident cases take several years.
Some things which can affect how long your case takes are:
1. Fault. Does the insurance company admit that your crash was completely the trucker’s fault or do they claim that you are partly or completely responsible?
2. Injuries and Treatment. How serious are your injuries? How long did your treatment take? Cases involving serious injuries and longer treatment can take longer than ones involving less serious injuries and shorter term care.
3. How much are you asking for? If you are seeking a lot of money your case may take longer than if you are seeking a small amount of damages.
4. Settlement or Trial. Does your case settle during negotiations or go to trial? A negotiated settlement is usually faster than a jury trial.
Will my case go to court?
Probably Not. By go to court people often mean will there be a trial in your case. Nationally, most personal injury cases settle before trial. Only a small percentage actually go to trial. Whether your case goes to trial depends on a number of factors like whether the insurance company agrees that their driver was at fault and the negotiation positions of the parties.
